Trespass
In law, trespass is
the act of going into someone's land or property without permission of the
owner of that land or
property.
In some states , Trespassing is an offense with high penalty. In other states, it is not deemed a
crime.
Trespass is not limited to human beings only . For example, if any animal
trespasses into anyone property or land
then the owner of cattle
or dogs may be tasked with an animal's trespass in some states.
Trespass to land occurs when a person directly enters into an additional's land
without permission, or remains in the land, or
places any
object in someone's land without his/her past permission.
This tort is actionable per se without the need to
prove damage.
By contrast, nuisance is an indirect interference with an additional's use and
enjoyment of land, and normally
requires proof of damage to be actionable.
The ways in which trespassing may occur
1. Entering upon land :
Walking onto one's land without permission, or refusing to leave when permission
has been
withdrawn, or throwing objects onto land are all example of trespass to
land.
2. Trespass to the airspace : Trespass to airspace above the
land can be committed. Trespass by allowing an advertising
board to project eight inches into someone's property at ground level and
an additional above ground level. Civil Aviation Act
1982 provides that no action
shall lie in trespass by reason only of the flight of an
aircraft over any property at a height
above the ground which is reasonable.
At common law a trespass was not criminal unless it was accomplished by
violence or breached the peace. Some modern
statutes make any unlawful entry onto an additional's property a crime. When the
trespass is based upon violence or injury to a person
or property, it is always deemed criminal, and penalties may be
increased for additional severe or malicious acts. Criminal
intent may have to be proved to convict under some statutes, but in some
states trespass is a criminal offense irrespective of
the defendant's intent.
Some statutes consider a trespass criminal only if the defendant has an
unlawful purpose in entering or remaining in the place
where he has no right to be. The unlawful purpose may be an attempt to
disrupt a government office, theft. Statutes in some
states specify that a trespass is not criminal until after a warning,
either spoken or by posted signs, has been given to the
trespasser. Criminal trespass is punishable by fine or imprisonment or
both.
